1. Acceptance of Terms

By downloading, installing, or using the SilverMind mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

SilverMind is a brain training application designed for older adults. The App provides cognitive exercises across memory, speed, and attention categories. SilverMind is intended for entertainment and general wellness purposes only.

Medical Disclaimer: SilverMind is not a medical device and does not provide medical advice, diagnosis, or treatment. The brain training exercises are designed for general cognitive wellness and should not be considered a substitute for professional medical advice. Always consult a qualified healthcare provider with questions about cognitive health.

3. Subscriptions and Payments

Free and Premium Access

SilverMind offers both free access and a premium subscription ("SilverMind Premium"). Some features may be limited without a premium subscription.

Subscription Terms

• SilverMind Premium is available as a monthly or yearly subscription.
• Payment is charged to your Apple App Store or Google Play Store account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• You can manage and cancel your subscription in your App Store or Google Play Store account settings.

Free Trials

If a free trial is offered, the trial period will be specified at the time of purchase. If you do not cancel before the trial period ends, you will be automatically charged the subscription price.

Refunds

Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

4. User Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to bypass any subscription or payment mechanisms
• Use the App for any unlawful purpose
• Redistribute, sublicense, or resell the App or its content

5. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, game designs, and software — are owned by SilverMind and are protected by copyright, trademark, and other intellectual property laws.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by applicable law, SilverMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SilverMind operates, without regard to its conflict of law provisions.
